These Terms of Service (“Terms”) govern your access to and use of the Petivano website (the “Site”) and the purchase of products through our online store.
By visiting the Site or placing an order, you agree to be bound by these Terms and the policies referenced herein, including our Privacy Policy, Cookie Policy, Shipping Policy, Refund Policy, and Warranty Policy.
If you do not agree with these Terms, please do not use the Site.
Throughout these Terms, “Company,” “we,” “us,” or “our” refers to Petivano, and “you” or “customer” refers to any Site visitor, user, or purchaser.

3. Product Orders & Payment
Order Process
When you place an order, you are submitting an offer to purchase the selected product or products.
After submitting an order, you may receive an order confirmation acknowledging receipt of your order. This confirmation does not necessarily constitute final acceptance of the order.
We officially accept your order when we charge your payment method and dispatch the product, unless otherwise stated.
We may refuse or cancel an order at any time for reasons including suspected fraud, inventory issues, pricing errors, technical errors, or incorrect product information.
If an order is canceled after payment has been processed, we will notify you and issue a refund of amounts paid for the canceled order.
Order Changes & Cancellations
We process orders promptly and cannot guarantee that an order can be modified or canceled after it has been submitted.
If an order has already entered fulfillment or has shipped, it cannot be canceled. Eligible products may instead be returned according to our applicable return and refund policy.
Pricing & Availability
Prices are displayed in U.S. Dollars (USD) unless otherwise stated and may be subject to applicable taxes.
We make reasonable efforts to ensure product descriptions, prices, images, and availability information are accurate.
If a product is listed with an incorrect price or material error, we may contact you to confirm whether you wish to proceed at the corrected price or cancel the order for a full refund.
Products are subject to availability. If an item becomes unavailable after you place an order, we may notify you and offer an alternative product or refund.
Payment
We accept payment methods displayed at checkout.
By submitting payment information, you represent that you are authorized to use the payment method provided.
Payments are processed through third-party payment providers. We do not store full payment card numbers.
If payment fails, is reversed, or is subject to an unauthorized chargeback, we may cancel the order or take appropriate steps to recover amounts owed.
Prices, promotions, and product availability may change without notice.
4. Taxes & Duties
Orders shipped within the United States may be subject to applicable sales tax, which may be calculated at checkout.
Petivano currently ships within the United States.
If we offer shipping to other countries in the future, customers may be responsible for applicable import duties, VAT/GST, customs fees, and other charges unless otherwise stated at checkout.
5. Shipping & Delivery
We fulfill orders through professional third-party logistics and fulfillment partners.
Processing Time: Orders are typically processed within 1–3 business days, Monday through Friday, excluding holidays. Processing may take longer during sales, holidays, or periods of high order volume.
Shipping: We currently offer Free Standard Shipping on orders within the United States.
Typical Transit Time: Approximately 5–7 business days after processing.
Delivery estimates are estimates only and are not guaranteed.
Delays may occur due to carrier issues, weather, holidays, incorrect addresses, or other circumstances beyond our reasonable control.
Tracking information will generally be provided when your order ships.
Risk of Loss & Delivery
Risk of loss generally passes to you upon delivery to the shipping address provided with your order, except where otherwise required by applicable law.
If a package is lost, significantly delayed, or damaged during transit, contact us within 14 days so that we can assist with a carrier investigation and, where appropriate, a replacement or refund.
Incorrect or Undeliverable Addresses
You are responsible for providing a complete and accurate shipping address.
If a package is undeliverable, refused, or returned because of an incorrect or incomplete address, additional shipping charges may apply for reshipment.
If a refund is issued, we may deduct applicable return-to-sender and outbound shipping costs where permitted by law.

6. Returns, Exchanges & Refunds
Eligible products may be returned within 30 days of delivery, subject to the conditions described in our applicable Refund Policy.
Returned products should generally be in their original condition and include all original packaging and accessories.

Return shipping costs may be the responsibility of the customer unless the product was defective, damaged during transit, or incorrectly shipped by us.
Refunds for approved returns will generally be issued to the original payment method after the returned product has been received and inspected.
Refund processing times may vary depending on your payment provider or financial institution.
Certain products or circumstances may be excluded from returns where permitted by applicable law.

7. Product Descriptions, Specifications & Warranty
We make reasonable efforts to accurately describe Petivano products.
Product colors and appearance may vary depending on your display settings, lighting, photography, and other factors.
Product specifications may change from time to time as we improve or update our products.
The Petivano Fountain is covered by a 3-Year Limited Warranty against manufacturing defects in materials and workmanship, subject to the terms and exclusions of our Warranty Policy.
The warranty does not cover normal wear and tear, accidental damage, misuse, improper cleaning or maintenance, unauthorized modifications or repairs, pet damage, consumable components such as filters and sponges, or other exclusions described in the Warranty Policy.

8. User Reviews & Content
By posting a review, photograph, comment, testimonial, or other content on or in connection with the Site, you grant Petivano a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, display, and distribute that content for marketing, advertising, customer support, and Site operation.
You represent that you own or control the rights necessary to provide the content and that your content does not violate the rights of any third party.
We may moderate, edit, restrict, or remove content that we reasonably believe is unlawful, deceptive, misleading, infringing, abusive, or otherwise inappropriate.
9. Intellectual Property
All trademarks, logos, service marks, product names, graphics, designs, photographs, text, and other intellectual property displayed on the Site are owned by Petivano or their respective owners.
You may not use, reproduce, copy, modify, distribute, or exploit our intellectual property without prior written permission.

11. Limitation of Liability

To the maximum extent permitted by law, our total aggregate liability arising from a particular purchase or claim shall not exceed the amount you paid for the product giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
12. Force Majeure
Petivano will not be responsible for any failure or delay in performance caused by circumstances beyond our reasonable control.
These circumstances may include natural disasters, fires, epidemics or pandemics, governmental actions, war, terrorism, labor disruptions, supply-chain interruptions, carrier disruptions, internet outages, or other events beyond our reasonable control.
13. Governing Law & Dispute Resolution
These Terms are governed by applicable law and, to the extent permitted by law, the laws of the jurisdiction applicable to Petivano.
Any dispute arising from these Terms or your use of the Site will be handled in accordance with applicable law.
Nothing in this section limits any rights or remedies that cannot legally be waived or restricted.

You may not misuse the Site, including:
- Scraping or harvesting Site content or customer information.
- Attempting to gain unauthorized access to the Site or its systems.
- Reverse-engineering or attempting to extract source code where prohibited by law.
